TERMS OF SERVICE (CIRCA by RB)
These Terms of Service (“Terms”) govern your use of this website and any purchases made from Agata Michi, SL (Sociedad Limitada Unipersonal), trading as CIRCA by RB (“we”, “us”, “our”).

2) Using the website
You agree to use this website lawfully and not to misuse it, including by attempting to interfere with its operation, access restricted areas without authorisation, or submit false or fraudulent information.
We may suspend or restrict access to the website where reasonably necessary for security, maintenance, or to prevent misuse.
3) Products (vintage, one-of-a-kind)
All items sold are genuine vintage/second-hand and one-of-a-kind. Each listing relates to the specific item shown. Once sold, the item cannot be restocked.
Vintage items may show minor signs of age and prior use. Such characteristics are inherent to vintage goods and are not considered defects unless specifically described as such.
Photographs form part of the description. Please read each listing carefully and review all images before purchasing.
4) Prices, currency and taxes
Our base currency is EUR. Depending on your location and checkout settings, prices may be displayed in another currency for convenience. The final charge is determined at checkout and/or by your payment provider.
Where applicable, sales of second-hand and vintage goods are made under the Spanish Special Scheme for Second-Hand Goods (REBU – Régimen Especial de Bienes Usados).
In such cases, VAT is included in the price but is calculated on the seller’s margin and is not shown separately on invoices. VAT charged under the REBU scheme is not deductible by the buyer.
For any items not subject to REBU, VAT will be applied in accordance with applicable law.
5) Orders and acceptance
Placing an order constitutes an offer to purchase. An order is accepted when we confirm it and/or dispatch the item.
We may refuse or cancel an order in cases such as suspected fraud, payment issues, or an obvious listing error. If cancelled after payment, you will receive a refund.
6) Payment
Payment is taken at checkout using the available payment methods. You confirm that the payment details provided are correct and that you are authorised to use them.
7) Shipping
Shipping is governed by our Shipping Policy, including processing times, tracking (where available) and delivery estimates.
Unless we expressly state otherwise (for example, in a promotion or at checkout), shipping costs are paid by the buyer and will be shown at checkout before you complete your purchase.
For deliveries outside the EU, your order may be subject to import duties, customs charges and local taxes. Unless these charges are collected at checkout, they are the buyer’s responsibility and are payable to the relevant authorities or carrier upon delivery.
Customs authorities may require additional information or documentation and may delay delivery. We are not responsible for customs delays or for any fees charged by customs or the carrier.
If you refuse to pay import charges or fail to accept delivery and the parcel is returned to us or abandoned, we may refund the item price only after it is returned (if returned), less any return shipping costs, customs charges, handling fees or loss in value, as permitted by law.
8) Returns, withdrawals and refunds
Returns and refunds are governed by our Returns & Refunds Policy.
Where applicable, consumers in the EU/EEA have a statutory right of withdrawal within 14 days from delivery of the goods, subject to legal conditions and exceptions, as explained in our Returns & Refunds Policy.
Returned items are inspected upon arrival. If an item is returned damaged or due to inadequate packaging, we may apply a reasonable deduction to reflect any loss in value, as set out in our Returns & Refunds Policy.
9) Liability
Nothing in these Terms limits or excludes liability where it would be unlawful to do so.
To the maximum extent permitted by law, we are not liable for indirect or consequential losses (including loss of profits, business interruption, or loss of data). Our total liability in connection with any purchase shall not exceed the amount paid for the relevant item (including standard delivery costs, where applicable), except where mandatory consumer law provides otherwise.
10) Force majeure
We are not responsible for delays or failures caused by events beyond our reasonable control (including carrier disruptions, customs delays, strikes, natural events, or system outages).
11) Intellectual property
All website content (text, photographs, branding, and design) is owned by or licensed to us. You may not copy, reproduce, distribute, or use it for commercial purposes without our prior written permission.
12) Privacy
Our handling of personal data is described in our Privacy Policy.
13) Newsletter Membership Benefit
Members of the CirCa newsletter receive a 10% courtesy discount on their purchases.
The discount remains valid while the customer maintains an active subscription.
It cannot be combined with other promotional offers and may be amended or withdrawn at our discretion.
14) Changes to these Terms
We may update these Terms from time to time. The version published on the website at the time of your purchase applies to that purchase.
15) Governing law and jurisdiction
These Terms are governed by the laws of Spain. If you are a consumer, you may also benefit from mandatory consumer protection rules in your country of residence. Any disputes shall be subject to the courts with jurisdiction under applicable consumer law.
16) Severability
If any provision of these Terms is held to be unlawful, invalid or unenforceable, the remaining provisions shall remain in full force and effect.
17) No waiver
If we do not enforce any right or provision under these Terms, this will not constitute a waiver of that right or provision.
